Terms of Service

The terms that govern access to and use of AFAI websites, content, and digital services.

1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of websites, content, tools, forms, applications, and other digital services operated by the American Foundation for Artificial Intelligence, Inc. (“AFAI,” “we,” “us,” or “our”). By accessing or using a Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Additional terms may apply to a particular program, event, grant, donation, application, research project, or tool. If additional terms conflict with these Terms, the more specific terms control for that activity.

2. Eligibility and Authority

You must be legally able to enter into these Terms. If you use a Service on behalf of an organization, you represent that you have authority to bind that organization. Services intended for minors may require participation by, or permission from, a parent, guardian, school, or other authorized institution.

3. Informational and Educational Services

AFAI provides public-interest, educational, research, and charitable information. Unless expressly stated otherwise, content and tools are provided for general informational and educational purposes. They are not legal, medical, financial, tax, employment, cybersecurity, or other professional advice and should not be treated as a substitute for advice from a qualified professional. Artificial intelligence and related information can change quickly. We do not promise that every item will remain current, complete, or suitable for a particular purpose.

4. Permitted Use

You may access and use the Services for lawful personal, educational, research, civic, or organizational purposes consistent with these Terms and any instructions displayed in a Service. You are responsible for your activity, your devices and credentials, and the accuracy and lawfulness of information you submit.

5. Prohibited Use

You may not use the Services to violate law or another person’s rights; harass, threaten, exploit, or deceive others; distribute malware or harmful code; gain unauthorized access; disrupt operation or security; bypass access controls or usage limits; misrepresent affiliation with AFAI; scrape or automate access in a manner that burdens the Services; or use AFAI content, identity, or systems for fraud, impersonation, unlawful surveillance, or other harmful conduct. The Acceptable Use Policy provides additional detail.

6. Intellectual Property

The Services and their original content, design, trademarks, logos, and software are owned by AFAI or its licensors and are protected by applicable law. These Terms do not transfer ownership. You may link to public pages and make reasonable noncommercial use of publicly available material with accurate attribution unless a page states different license terms. Open-source software, datasets, models, publications, and educational materials may be governed by a separate license shown with the resource. That separate license controls your use of that material.

7. Submissions and Feedback

You retain ownership of content you submit. You grant AFAI a nonexclusive right to host, process, reproduce, and use that content as reasonably necessary to provide the requested Service, evaluate a submission, administer a program, or respond to you. Do not submit content you lack permission to share. If you voluntarily provide general feedback or suggestions, AFAI may use them without restriction or compensation, provided we do not publicly identify you without permission.

8. Donations and Transactions

Donations are subject to the information presented at checkout and applicable law. Tax treatment depends on individual circumstances; AFAI does not provide tax advice. Unless a contribution is accepted with a written restriction, AFAI may use it in support of its charitable mission. Third-party processors may apply additional terms to payment transactions.

9. Third-Party Services

The Services may link to or integrate third-party websites, software, models, platforms, or content. AFAI does not control those services and is not responsible for their availability, security, accuracy, or practices. Your use of a third-party service is governed by its own terms and policies.

10. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” AFAI DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AFAI AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, OPPORTUNITY, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES. Any liability that cannot lawfully be excluded will be limited to the extent permitted by applicable law.

12. Suspension and Termination

We may restrict or terminate access when reasonably necessary to protect users, AFAI, partners, or the public; address suspected violations; comply with law; or maintain the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination—including intellectual-property, disclaimer, and liability provisions—will survive.

13. Governing Law and Changes

These Terms are governed by the laws applicable in Puerto Rico and the United States, without regard to conflict-of-law principles, except where applicable law requires otherwise. Disputes will be brought in a court with appropriate jurisdiction in Puerto Rico unless the parties agree to another lawful process. We may update these Terms. The updated version will be posted with a revised date, and continued use after the effective date constitutes acceptance of the revised Terms.
